- 1) What is a DUI?
In Tennessee, an individual may not drive a vehicle if their blood alcohol content is .08 or above. It does not require much to obtain a blood-alcohol level that violates the law.
- 2) Should I take the breath test?
If you have not had any alcohol, the test will prove you have not violated the law. If you come to question how much alcohol you have had, the breath test may prove disappointing for you. Due to the level of accuracy of the machines, they are presumed to be accurate and .08 blood alcohol reading will get you arrested. You may choose to refuse taking the test, but do understand refusing to take the breath test as requested by an officer with probable cause, may suspend your license for a period of one year.
- 3) Can I obtain a restricted license?
A restricted license is available to first offenders ONLY. If you have a DUI conviction on your record and plead to a second first-offense DUI, you are not eligible for a restricted license during your year of probation but the 2nd year of suspension is eligible for a restricted license. Failure to take the breathalyzer test may suspend your license for one year but one is eligible for a restricted license. Third and subsequent DUI convictions are not eligible for a restricted license at all.
- 4) What are DUI penalties?
- First Dui Offense:
This can be one or a combination of the following:
Fine: Ranging from a min. $350.00 – max $1,500.00
Jail Time: mandatory consecutive 7 days if blood alcohol readings exceed .20%
Driver’s license revoked for one year
- Second Dui Offense:
This can be one or a combination of the following:
Fine: Ranging from a min. $600.00 – max $3,500.00
Jail Time: Ranging from 45 days minimum to 11 months and 29 days maximum
Driver’s license revoked for two years
Alcohol and drug treatment programs available as jail credit
Forfeiture of vehicle if used in the offense
- Third Dui Offense:
This can be one or a combination of the following:
Fine: Ranging from a min. $1,100.00 – max $10,000.00
Jail Time: Ranging from 120 days minimum to 11 months and 29 days maximum
Driver’s license revoked for 3-10 years
Alcohol and drug treatment programs available as jail credit
Forfeiture of vehicle
- Fourth DUI Offense:
This can be one or a combination of the following:
Conviction of a Class E felony
Fine: Ranging from a min. $3,000.00 – max $15,000.00
Jail Time: Ranging from 150 days minimum to 6 years maximum
Driver’s license revoked for 5 years
Alcohol and drug treatment programs available as jail credit
Forfeiture of vehicle
